PARTICIPANT AGREMENT, WAIVER AND
RELEASE OF LIABILITY
In consideration of being allowed to rent a Snowmobile, Snowshoe or other snow sports equipment and/or participate in any way in athletics/snow sports activities (skiing, snowshoeing, etc.), and related events, the undersigned:
1. Release, waive, discharge and covenant not to sue Outdoor Sports, its parent company, MicroConn, Inc. and their respective owners or directors, its affiliated clubs, their respective administrators, directors, agents, coaches, and other employees of the organization, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and leasers of premises used to conduct the business/activity, all of which are hereinafter referred to as "releases", from any and all liability to each of the undersigned, his or her heirs, next of kin, assigns, personal representatives, and estate for any and all claims, demands, losses or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of the releases or otherwise.

2. Agree to inspect the facilities and equipment to be used, and if believed anything is unsafe, the undersigned will immediately advise the appropriate personnel of such conditions(s) and refuse to rent the equipment and/or participate in the activity.

3. Acknowledge and fully understand that each participant will be engaging in activities that involve risk of serious injury, including permanent disability and death, and severe social, and economic losses which might result not only from their own actions, inactions or negligence but the actions, inactions or negligence of others, or the conditions of the premise or of any equipment used. Further, that there may be other risks not known or not reasonably foreseeable at this time and not mentioned on this release.

4. Assume all the foregoing risk and accept personal responsibility for the rented equipment and personal damages following such injury, permanent disability or death.

5. Never to bring suit or any legal action against the releases with regard to any consequence which may occur as a result of this action.

6. To abide by all federal, state and local regulations pertaining to operation of a water craft or kayak.

7. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in an event or while operating a rented equipment, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

8. Snowmobile is to be operated as required by laws of State of California. If I do not follow the rules and exhibit unsafe behavior I can be asked to return the equipment and/or leave the event and can forfeit any all paid fees. This judgment will be left to the discretion of the of the Outdoor Sports personnel. We have asked any questions regarding the equipment, operation of equipment or any aspect of the event, which might be unclear at this time.

9. In the event that I file a lawsuit against the releases, I agree to do so solely in the state of California, and I further agree that the substantive law of California shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

WE HAVE READ THE ABOVE WAIVER AND RELEASE, UNDERSTAND THAT WE GIVE UP SUBSTANTIAL RIGHTS BY SIGNING IT AND SIGN IT VOLUNTARILY. By signing this document, we acknowledge that If anyone is hurt or property is damaged during his/her participation in this activity, they may be found by a court of law to have waived their right to maintain a lawsuit against the releases on the basis of any claim from which they have released them herein. We have had sufficient opportunity to read this entire document. We have read and understand it, and agree to be bound by its terms.
